In Alabama the penalties for a first time DUI conviction can include the following:

For the first offense of DUI in Alabama, you will be facing the following maximum penalties:

  • up to one year in jail
  • 90 day license suspension
  • Up to a $2,100 fine
  • Court costs
  • Mandatory completion of DUI school

For the second offense of DUI in Alabama, you will be facing the following maximum penalties:

  • Mandatory minimum 5 days in jail, up to one year in jail
  • 1 year license revocation
  • Fine from $1,100 and up to a maximum fine of $5,100
  • Court costs
  • Mandatory completion of DUI school

Insurance provider’s guidelines and rating systems differ so you will need to check with your insurance provider to know if your rates will be affected by your son’s DUI. While he remains on your policy it is likely that his DUI will cause your rates to go up, since alcohol offenses are normally taken seriously by an insurance carrier.

If you want to cancel or exclude your son from your policy you will need to contact to your insurance company to find out how this may be done. If your son takes out his own car insurance policy you will probably be required to show proof of his policy to your insurer in order for them to remove him as a driver from your policy.

Alabama can require a driver to carry a SR-22 for different reasons. If your previous state of mandated that you maintain and continue to carry a SR-22 for a certain amount of time and that time period is not up yet then you will need to continue your SR-22 coverage in Alabama when you change over your driver’s license to an Alabama license.

SR-22s are state specific so this means that what is required in one state may not apply in another state. When you move to Alabama, you will need to keep your former state mandated limits.

If you currently carry an SR-22 in one state but move to another state, you must fulfill the SR-22 filing period for your former state, even though you are no longer a resident there. In addition to that your insurance policy for your new state must have liability limits which meet the minimums required by law in your former (SR-22) state.

Thank you for asking Daniel.

First time offense of a DUI or DWI in the state of Alabama would result to a penalty of paying a fine of $600 to $2,100, up to one year in jail or by both fine and imprisonment. Also the person’s driver’s license will be suspended for 90 days.

Other than that we those convicted of Driving under the Influence in Alabama are also required to post SR-22 insurance and attend and complete a DUI or substance abuse program.

In Alabama the SR2-2 will be required to be maintained for a period of three years but the DPS should give you information on how long you will actually be required to file SR22. You may contact the Alabama Department of Public Safety to get more information and to verify for how long you will be required to hold a SR-22 if you have been convicted of a DUI/DWI violation.
